1. Introduction

Welcome to theuxbites! These Terms of Service ("Terms") govern your access to and use of theuxbites services, including our website, software platform, APIs, documentation, tools, and all related services (collectively, the "Service").

By using the Service, you agree to these Terms. If you do not agree to these Terms, please do not use the Service.

Please also read our Privacy Policy, which provides detailed information about how we handle your data.

2. Service Description

theuxbites is a platform that enables comprehensive analysis of websites' user experience. We review your website, cross-reference performance metrics with usability best practices, and analyze the results. The service includes:

• Automated UX audits
• Performance analysis and evaluation
• Prioritized improvement recommendations
• SEO scores and analysis
• Audit history and comparison
• Kanban board for issue management

3. Subscription Plans and Payment

3.1. Subscription Tiers

theuxbites offers three subscription tiers:

• Lite: Free plan, 3 audits per month
• Pro: Paid plan, 25 audits per month
• Studio: Paid plan, 100 audits per month

3.2. Payment

Payment is processed through the Stripe payment platform. Accepted payment methods include credit cards, PayPal, and other methods supported by Stripe.

Subscription fees are charged in advance on a monthly or annual billing cycle. Prices are as displayed on the site and include applicable taxes.

3.3. Automatic Renewal

Subscriptions automatically renew at the end of each billing period unless you cancel your subscription in a timely manner.

3.4. Refunds

Outside the statutory right of withdrawal described in section 3.5, refunds are evaluated on a case-by-case basis. We generally do not provide refunds for services already used, but we review each case individually. This is a goodwill policy: it applies in addition to your statutory rights and never instead of them.

3.5. Right of Withdrawal (Consumers)

If you are a consumer — a natural person acting outside your trade, business or profession — you have the right to withdraw from a paid subscription within 14 days without giving any reason. The period begins on the day the contract is concluded.

To exercise it, tell us in a clear statement. An email to hello@theuxbites.com is enough; sending it before the 14 days expire is all that is required. You may use the model form below, but you do not have to.

If you withdraw, we refund every payment we received from you without undue delay and no later than 14 days from the day we are informed, using the same means of payment you used. The refund costs you nothing.

Your plan becomes active as soon as payment succeeds, so you can use it during the withdrawal period. If you withdraw after using it, we may deduct an amount proportionate to what you used before you told us; the remainder is refunded.

We do not ask you to waive this right, and nothing in these Terms limits it. The right does not apply to business customers.

4. User Account

To use the Service, you must register for an account. You are responsible for:

• Providing accurate and complete information during registration
• Maintaining the security of your account, including your password
• All activities that occur under your account
• Immediately notifying us if you suspect unauthorized use of your account

5. Acceptable Use

You agree to use the Service only for lawful purposes and agree not to:

• Violate any laws or regulations in any way
• Send or share harmful, threatening, harassing, or offensive content
• Distribute viruses, malicious code, or other harmful software
• Attempt to circumvent or breach the security of the Service
• Use automated systems or bots to access the Service
• Attempt unauthorized access to others' accounts
• Use the Service for commercial purposes without proper authorization

6. Intellectual Property

All content of the Service, including software, logos, trademarks, text, graphics, and other materials, is the property of theuxbites or its licensors and is protected by copyright, trademark, and other intellectual property laws.

You may not copy, modify, distribute, display, or otherwise use these materials without our permission.

8. Service Modifications and Termination

We reserve the right to modify, suspend, or discontinue the Service or any part thereof at any time without prior notice.

You may terminate your account at any time through your subscription settings.

9. Limitation of Liability

The Service is provided "as is" without warranty. We do not assume liability for:

• Continuous availability or error-free operation of the Service
• Accuracy or completeness of audits
• Indirect, incidental, special, or consequential damages
• Data loss or corruption

9.1. Guidance, Not Professional Advice

Everything the Service produces — audits, scores, recommendations, analyses and the EU AI Act Article 50 check — is guidance. Its purpose is to help you recognise what may need to change. It is not legal, regulatory, financial or other professional advice, and it does not establish that you, your product or your website meet any law or standard.

The Article 50 check applies fixed rules to the answers you give. It works only from the official sources it lists, as they read on the date it states. We do not review your product, we do not verify your answers, and we do not determine whether you meet the EU AI Act or any other regulation. A result of "not triggered" is not a confirmation of compliance.

theuxbites is an independent product. The Article 50 check is not an official tool of the European Union and is not affiliated with, endorsed by or reviewed by the European Commission or any authority.

We give no undertaking to keep the check, or any other regulatory content in the Service, current, complete or updated when the law, official guidance or its interpretation changes. The official sources are always the authoritative and current version.

You remain responsible for your own decisions and for meeting your legal obligations. Before acting on anything the Service tells you about a legal or regulatory matter, confirm it with a lawyer or another qualified professional. We do not accept liability for decisions made, or not made, on the basis of the Service's output. Nothing in these Terms limits liability that cannot be limited under applicable law.

10. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you by email of significant changes. Continued use of the Service after publication of changes constitutes acceptance of the modified Terms.

12. Governing Law

If any part of these Terms is found to be invalid or unenforceable, the remaining parts shall remain in full force and effect.

These Terms are governed by the laws of Austria, excluding its conflict-of-law rules and the UN Convention on Contracts for the International Sale of Goods (CISG).

If you are a consumer, this choice of law does not deprive you of the protection afforded to you by provisions that cannot be derogated from under the law of the country where you have your habitual residence, and you may bring proceedings in the courts of that country. Nothing in these Terms limits your mandatory statutory rights.

If you are a business, the exclusive place of jurisdiction for all disputes arising out of or in connection with these Terms is the court with subject matter jurisdiction for Sankt Johann im Pongau, Austria.
